In the wake of the unexpected decision on the project for the new Porta Elisa stadium in Lucca by the City Council, which defined it as “not respecting the conditions set by the CC.” comes the warning from Aurora Immobiliare, the agent of the R.T.I. of 22 05 2024, which, through this act, officially responds to the arguments of the municipality.
But before we look in detail at what has been asserted, let us review the salient stages of the development of the proposal for the new Lucca Porta Elisa Stadium:
-08/08/2019 initiates the project development process with the Proposal of a Feasibility Study for the “City of Lucca Stadium” project;.
-15/04/2021 full submission of the feasibility project by R.T.I.;
-14/05/2021 calling and convening of the Preliminary Services Conference;
-26/04/2022 Declaration of Public Interest of the proposal, pursuant to Law no.147/2023, art.1 paragraph 304, lett. a);
-12/05/2023 Submission and protocol of the Final Project.
A year later (despite an official acknowledgement reiterating interest in the continuation of the procedure in January) comes the City’s reconsideration with the declaration of ineligibility for the Decisional Services Conference.
As much as the City of Lucca has justified its decision not to grant the extension, despite the Proponent Company’s stated compliance with the initial conditions, the Proponent Company, which has always acted in accordance with the provisions of the law, nonetheless emphasizes how there has been an investment of effort, resources and energy expended by the
work team, precisely for the advancement of the project, in compliance with the deadlines and conditions established at the outset, however unmotivated.
In detail, the notice sent to the City of Lucca by Aurora Immobiliare contemplates three main points:
1. Illegality of the measure. The Proponent challenges the decision of the City of Lucca regarding the denial of the requested extension and the closure of the proceedings regarding the project financing proposal for the construction of the
new stadium. The deadline given for submitting documents is definitely unreasonable;
2. on the date of submission of the Final Project, contrary to what was opposed in the documents closing the proceedings, Legislative Decree no. 36/2023;
3. the approval of any Urban Variant is not the responsibility of the Municipal Administration and the relevant design drawings are not part of the Final Project to be paid for by the Proponent, which has in any case reiterated its willingness to the relevant documentary production within a congruous deadline, certainly not 10 days as set by the municipal administration;
4. the P.E.F. affidavit attached to the Final Project is in full compliance with all legal requirements.
In the face of further evaluations, but still standing firm on its decisions, Aurora Immobiliare renews its willingness to be able to pick up where it left off, for the continuation of the project presented, with the aim of building a state-of-the-art, sustainable stadium worthy of a city like Lucca.
